CKL Law has a practice focused on making sure employees are paid properly.  Generally called “wage and hour” claims, CKL Law focuses on pursuing employer violations of the Fair Labor Standards Act (“FLSA”) and Florida’s Minimum Wage Act.

The FLSA governs the payment of wages to most employees in the United States.  It governs the payment of minimum wage, overtime compensation and paycheck deductions.  A surprising number of employers fail to pay their employees properly; sometimes because the employer does not understand what the various laws require and sometimes because the employer does understand what is required, but the employer does not want to pay its employees the additional wages they have earned.  There are also many misconceptions about the laws and what they require.

In addition to requiring proper payment of minimum wages and overtime, the FLSA states that an employer who violates the FLSA must pay the employee an additional amount equal to the unpaid mininum wages or overtime as liquidated damages AND the employer must pay the employee's costs and attorney fees.

The FLSA also prohibits employers from retaliating against an employee who asserts their rights to minimum wages or overtime pay under the FLSA, whether a complaint is formal or informal, written or verbal.
